Available in PDF, EPUB and Kindle. Book excerpt: Cannibalism and the Common Law is an enthralling classic of legal history. It tells the tragic story of the yacht Mignonette, which foundered on its way from England to Australia in 1884. The killing and eating of one of the crew, Richard Parker, led to the leading case in the defence of necessity, R. v. Dudley and Stephens. It resulted in their being convicted and sentenced to death, a sentence subsequently commuted. In this tour de force Brian Simpson sets the legal proceedings in their broadest historical context, providing a detailed account of the events and characters involved and of life at sea in the time of sail. Cannibalism and the Common Law is a demonstration that legal history can be written in human terms and can be compulsive reading. This brilliant and fascinating book, a marvelous example of eareful historical detection, and first-class legal history, written by a master.

Book excerpt: In every culture there exists unwritten law—obligations and prohibitions that are understood and passed on, and transgressions that are punished. Folk Law, a comprehensive two-volume collection of essays, examines this meeting place of folklore and jurisprudence. The contributors explore the historical significance and implications of folk law, its continuing influence around the globe, and the conflicts that arise when folk law diverges from official law. The collection begins by defining various forms of “folk law,” drawing on examples from many cultures. The second section provides historical profiles of pioneering figures in the study of folk law. Following sections examine field research techniques used to identify folk laws; aspects of folk law within the realm of rituals, songs, and other forms of expressive culture; instances where folk law comes into conflict with national law, and the role of folk law in the international arena. The volumes also include description and analysis of two approaches to folk law—the rule approach, in which scholars dissect the codes that underlie folk law, and the case approach, in which researchers examine specific cases involving folk law. Valuable for students and scholars of law, folklore, or anthropology, this extensive casebook marks a rare interdisciplinary approach to two important areas of research.

Book excerpt: Law and Justice around the World is designed to introduce students to comparative law and justice, including cross-national variations in legal and justice systems as well as global and international justice. The book draws students into critical discussions of justice around the world today by: taking a broad perspective on law and justice rather than limiting its focus to criminal justice systems examining topics of global concern, including governance, elections, environmental regulations, migration and refugee status, family law, and others focusing on a diverse set of global examples, from Europe, North America, East Asia, and especially the global south, and comparing the United States law and justice system to these other nations continuing to cover core topics such as crime, law enforcement, criminal courts, and punishment including chapter goals to define learning outcomes sharing case studies to help students apply concepts to real life issues Instructor resources include discussion questions; suggested readings, films, and web resources; a test bank; and chapter-by-chapter PowerPoint slides with full-color maps and graphics. By widening the comparative lens to include nations that are often completely ignored in research and teaching, the book paints a more realistic portrait of the different ways in which countries define and pursue justice in a globalized, interconnected world.

Book excerpt: Sir William Blackstone's Commentaries on the Laws of England (1765-1769) stands as the first great effort to reduce the English common law to a unified and rational system. Blackstone demonstrated that the English law as a system of justice was comparable to Roman law and the civil law of the Continent. Clearly and elegantly written, the work achieved immediate renown and exerted a powerful influence on legal education in England and in America which was to last into the late nineteenth century. The book is regarded not only as a legal classic but as a literary masterpiece. Previously available only in an expensive hardcover set, Commentaries on the Laws of England is published here in four separate volumes, each one affordably priced in a paperback edition. These works are facsimiles of the eighteenth-century first edition and are undistorted by later interpolations. Each volume deals with a particular field of law and carries with it an introduction by a leading contemporary scholar. Introducing this second volume, Of the Rights of Things, A. W. Brian Simpson discusses the history of Blackstone's theory of various aspects of property rights—real property, feudalism, estates, titles, personal property, and contracts—and the work of his predecessors.

Available in PDF, EPUB and Kindle. Book excerpt: The growth in England and Britain’s merchant marine from the medieval period onwards meant that an increasing number of criminal offences were committed on or against the country’s vessels while they were at sea. Between 1536 and 1834, such crimes were determined at the Admiralty Sessions if brought to trial. This was a special part of the wider Admiralty Court, which, unlike the other forums in that tribunal, used English common law procedure rather than Roman civil law to try its cases. To a modest extent, this produced a ‘hybrid’ court, dominated by the common law but influenced by aspects of Europe’s other major legal tradition. The Admiralty Sessions also had their own (highly singular) regime for executing convicts, used the Marshalsea prison to hold their suspects and displayed the Admiralty Court’s ceremonial silver oar at their hearings and hangings. During the near three centuries of its existence, the Admiralty Sessions faced enormous legal and logistical problems. The crimes they tried might occur thousands of miles and months of sailing time away from England. Assembling evidence that would ‘stand up’ in front of a jury was a constant challenge, not least because of the peripatetic lives of the seafarers who provided most of their witnesses. The forum’s relationship with terrestrial criminal courts in England was often difficult and the demarcation between their respective jurisdictions was complicated and subject to change. Despite all of these problems, the court experienced significant successes, as well as notable failures, in its battle to deal with a litany of serious maritime crimes, ranging from piracy to murder at sea. It also spawned a series of Vice-Admiralty Courts in English and British colonies around the world. This book documents the origins, development and abolition of the Admiralty Sessions. It discusses all of the major crimes that were determined by the forum, and examines some of the more arcane and unusual offences that ended up there. Some of the unusual challenges presented by the maritime environment, whether the impossibility of preserving dead bodies at sea, the extensive power given to captains to physically punish sailors, the difficulty of securing suspects in small vessels, or the often gruesome problems occasioned by the marginal legal status of slaves, are also considered in detail.

Available in PDF, EPUB and Kindle. Book excerpt: The Politics of the Common Law offers a critical introduction to the legal system of England and Wales. Unlike other conventional accounts, this revised and updated second edition presents a coherent argument, organised around the central claim that contemporary postcolonial common law must be understood as an articulation of human rights and open justice. The book examines the impact of the European Convention and European Union law on the structures and ideologies of the common law and engages with the politics of the rule of law. These themes are read into normative accounts of civil and criminal procedure that stress the importance of due process. The final sections of the book address the reality of civil and criminal procedure in the light of recent civil unrest in the UK and the growing privatisation of public services. The book questions whether it is possible to find a balance between the requirements of economics and the demands of justice.

Available in PDF, EPUB and Kindle. Book excerpt: The cannibal has played a surprisingly important role in the history of thought--perhaps the ultimate symbol of savagery and degradation-- haunting the Western imagination since before the Age of Discovery, when Europeans first encountered genuine cannibals and related horrible stories of shipwrecked travelers eating each other. An Intellectual History of Cannibalism is the first book to systematically examine the role of the cannibal in the arguments of philosophers, from the classical period to modern disputes about such wide-ranging issues as vegetarianism and the right to private property. Catalin Avramescu shows how the cannibal is, before anything else, a theoretical creature, one whose fate sheds light on the decline of theories of natural law, the emergence of modernity, and contemporary notions about good and evil. This provocative history of ideas traces the cannibal's appearance throughout Western thought, first as a creature springing from the menagerie of natural law, later as a diabolical retort to theological dogmas about the resurrection of the body, and finally to present-day social, ethical, and political debates in which the cannibal is viewed through the lens of anthropology or invoked in the service of moral relativism. Ultimately, An Intellectual History of Cannibalism is the story of the birth of modernity and of the philosophies of culture that arose in the wake of the Enlightenment. It is a book that lays bare the darker fears and impulses that course through the Western intellectual tradition.

Book excerpt: Interdisciplinary Essays on Cannibalism: Bites Here and There brings together a range of works exploring the evolution of cannibalism, literally and metaphorically, diachronically and across disciplines. This edited collection aims to promote a conversation on the evolution and the different uses of the tropes and figures of cannibalism, in order to understand and deconstruct the fascination with anthropophagy, its continued afterlife and its relation to different disciplines and spaces of discourse. In order to do so, the contributing authors shed a new light not only on the concept, but also propose to explore cannibalism through new optics and theories. Spanning 15 chapters, the collection explores cannibalism across disciplines and fields from Antiquity to contemporary speculative fiction, considering history, anthropology, visual and film studies, philosophy, feminist theories, psychoanalysis and museum practices. This collection of thoughtful and thought-provoking scholarly contributions suggests the importance of cannibalism in understanding human history and social relations.

Available in PDF, EPUB and Kindle. Book excerpt: Some law students find jurisprudence daunting, impersonal, dry and seemingly detached from practical affairs. William Twining believes that many jurists have been fascinating people struggling with questions that are both historically significant and relevant to contemporary issues. This book brings together previously published essays that centre on three related themes: reading Juristic texts, the role of narrative in law, and relations between theory and practice. Building on a pragmatic view of jurisprudence, the author explores different ways of reading and using Juristic texts, to set them in context, to bring them to life and to engage with the reader's own concerns. He applies this approach to throw fresh light on four familiar figures - Holmes, Bentham, Hart and Llewellyn. Challenging limited agendas and parochial points of view, Twining outlines a programme for a broad approach to legal theory in the context of globalization. He satirizes some bad habits in jurisprudence and explores in depth how stories can be seductive vehicles for cheating in legal contexts, yet are essential for making sense of disputes about fact or law.

This book was released on 2003-08-07 with total page 288 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book takes a radical approach to the study of traditional songs. Folk song scholarship was originally obsessed with notions of completeness and narrative coherence; even now long narratives hold a privileged place in most folk song canons. Yet field notebooks and recordings (and, increasingly, publications) overwhelmingly suggest that apparently 'broken' and drastically shortened versions are not perceived as incomplete by those who sing them. Dealing with a wide range of traditions and languages, this study turns the focus on these 'dog-ends' of oral tradition, and looks closely at how very short texts convey meaning in performance by working the audience's knowledge of a highly allusive idiom. What emerges is the tenacity of meaning in the connotative and metaphorical language of traditional song, and the extraordinary adaptability of songs in different cultural contexts. Such pieces have a strong metonymic force: they should not be seen as residual 'last leaves' of a once-complete tradition, but as dynamic elements in the process of oral transmission. Not all song fragments remain in their natural environment, and this book also explores relocations and dislocations as songs are adapted to new contexts: a ballad of love and death is used to count pins in lace-making, song-snippets trail subversive meanings in the novels of Charles Dickens. Because they are variable and elusive to dating, songs have had little attention from the literary establishment: the authors show both how certain critical approaches can be fruitfully applied to song texts, and how concepts from studies in oral traditions prefigure aspects of contemporary critical theory. Like the songs themselves, this book crosses and recrosses the perceived divide between the literary and the oral. Coverage includes English, Welsh, Breton, American, and Finnish songs.

Available in PDF, EPUB and Kindle. Book excerpt: The first book-length study of London as a maritime writer Jack London’s fiction has been studied previously for its thematic connections to the ocean, but Jack London and the Sea marks the first time that his life as a writer has been considered extensively in relationship to his own sailing history and interests. In this new study, Anita Duneer claims a central place for London in the maritime literary tradition, arguing that for him romance and nostalgia for the Age of Sail work with and against the portrayal of a gritty social realism associated with American naturalism in urban or rural settings. The sea provides a dynamic setting for London’s navigation of romance, naturalism, and realism to interrogate key social and philosophical dilemmas of modernity: race, class, and gender. Furthermore, the maritime tradition spills over into texts that are not set at sea. Jack London and the Sea does not address all of London’s sea stories, but rather identifies key maritime motifs that influenced his creative process. Duneer’s critical methodology employs techniques of literary and cultural analysis, drawing on extensive archival research from a wealth of previously unpublished biographical materials and other sources. Duneer explores London’s immersion in the lore and literature of the sea, revealing the extent to which his writing is informed by travel narratives, sensational sea yarns, and the history of exploration, as well as firsthand experiences as a sailor in the San Francisco Bay and Pacific Ocean. Organized thematically, chapters address topics that interested London: labor abuses on “Hell-ships” and copra plantations, predatory and survival cannibalism, strong seafaring women, and environmental issues and property rights from San Francisco oyster beds to pearl diving in the Paumotos. Through its examination of the intersections of race, class, and gender in London’s writing, Jack London and the Sea plumbs the often-troubled waters of his representations of the racial Other and positions of capitalist and colonial privilege. We can see the manifestation of these socioeconomic hierarchies in London’s depiction of imperialist exploitation of labor and the environment, inequities that continue to reverberate in our current age of global capitalism.
